These Terms and Conditions govern access to and use of our application and associated services. By using guito, the user fully accepts these Terms. If you do not agree, please do not use the service.

1. Identification of the Service Provider

guito is a service operated by:

2. About guito

guito is a personal finance management application that allows users to organise and monitor their finances, including:

• Tracking of investment portfolios;
• Linking to bank accounts;
• Tax simulators and calculators;
• Artificial intelligence assistance features.

3. Age Requirements

The Services are intended for users aged 16 or over. Users between the ages of 16 and 18 must have authorisation from a parent or legal representative in order to use guito.

4. Use of the Service

By using guito, the user undertakes to:

• Use the service only for personal and lawful purposes;
• Not use the service for unlawful or unauthorised activities;
• Enter fictitious or real information, according to their personal simulation objective. guito does not verify the accuracy of the data entered;
• Not use the service to distribute malware, spam, or unlawful content;
• Not attempt to access unauthorised areas of the system;
• Not reverse-engineer, decompile or modify the software;
• Not resell or commercialise access to guito without authorisation.

5. User Account

Certain features may require the creation of an account. The account may be created with an email address and password or through the user's Apple or Google account; in that case, sign-in is handled by that provider and guito receives only the identification data described in the Privacy Policy. The user is responsible for:

• Maintaining the confidentiality of their credentials;
• All activities carried out on their account;
• Notifying guito immediately of any unauthorised use of their account.

6. Subscriptions and Payments

guito offers paid subscription plans that unlock premium features of the application. These subscriptions provide access to additional financial tracking and analysis tools. Subscriptions are not financial products, investments or regulated services — they are merely software features.

A subscription can be purchased through two routes, which differ as to who charges, where it is cancelled and who processes refunds:

• On the guito.pt website, where payment is processed by guito through its payment providers (section 6.2);
• In the guito mobile apps, where the purchase is processed by the app store, App Store (Apple) or Google Play (Google) (section 6.3).

Conditions common to both routes:

• The prices and features of each plan are shown before the purchase is confirmed;
• The subscription is activated immediately after payment or, where one applies, at the start of the free trial (section 6.4);
• Subscriptions renew automatically at the end of each period, unless cancelled beforehand;
• The user may cancel the renewal at any time, without penalties, keeping access until the end of the period already paid for;
• No refunds are issued for unused subscription periods, except in the cases provided for by law (see section 7).

6.1. Promotional Pricing

guito may offer promotional prices or special discounts (such as the "Preço Fundador") to users who subscribe during specific periods.

Promotional pricing conditions:

• The promotional price is maintained for as long as the subscription remains active and uninterrupted;
• If the user cancels the subscription, they lose the right to the promotional price;
• A new subscription following cancellation will be subject to the price in force at the time of reactivation;
• guito reserves the right to discontinue promotional offers for new subscribers at any time.

These conditions apply to subscriptions purchased on guito.pt. For subscriptions purchased in the mobile apps, the applicable price, and any introductory offer attached to it, are those shown by the store at the time of purchase.

6.2. Subscriptions purchased on guito.pt

Where the subscription is purchased on the website, guito is the seller and:

• Payments are processed securely through certified payment providers engaged by guito;
• The subscription is managed (changing plan, updating the payment method, entering a tax number (NIF), viewing invoices, cancelling or reactivating) in the account's billing area on guito.pt;
• Invoices for the subscription are issued by guito;
• The refunds provided for in section 7 are processed by guito.

6.3. Subscriptions purchased in the mobile apps (App Store and Google Play)

Where the subscription is purchased inside the guito mobile app, the purchase is made through the app store and not through guito. The following conditions apply:

• The purchase is processed and charged by the App Store (Apple) or Google Play (Google), using the account and payment method the user already holds with that store. guito neither receives nor handles the payment details;
• The applicable price is the one shown by the store, in that store's currency, before the purchase is confirmed;
• Automatic renewal, plan changes and cancellation are managed in the store's own subscription settings. Cancellation takes effect at the end of the period already paid for, and access is retained until that date;
• The proof of purchase is issued by the store and is available in the purchase history of the store account. guito issues no invoice and cannot attach a tax number (NIF) to these purchases;
• Refund requests, including the exercise of the right of withdrawal provided for in section 7, are submitted to the store and follow that store's terms. guito cannot process refunds for purchases made through the app stores;
• App Store: deleting the guito account or uninstalling the app does not cancel the subscription. Apple does not allow guito to cancel it, so cancellation must be carried out by the user in the App Store subscription settings, otherwise the store will continue to charge the renewal;
• Google Play: Google does allow guito to stop the renewal, so deleting the guito account cancels the Google Play subscriptions attached to that account. Access is retained until the end of the period already paid for, and the period in progress is not refunded. Uninstalling the app, on its own, does not cancel the subscription. If that cancellation cannot be completed (for example, because Google is unavailable), the subscription must be cancelled in the Google Play subscription settings, so we recommend confirming its status there.

Terms specific to App Store purchases: these Terms are concluded between the user and Luar Quieto — Unipessoal Lda, and not with Apple. Apple is not responsible for the application or its content and has no obligation whatsoever to furnish any maintenance or support services with respect to the application. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against the user. The following conditions also apply:

• Licence: the right to use the application is a limited, non-transferable licence to use it on Apple devices that the user owns or controls, as permitted by the usage rules set out in the App Store terms of service;
• Warranty: guito, and not Apple, is solely responsible for any warranty relating to the application, to the extent not validly disclaimed (section 14). If the application fails to conform to an applicable warranty, the user may notify Apple, and Apple will refund the purchase price of the application, if any; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the application;
• Product claims: guito, and not Apple, is responsible for addressing any claims by the user or a third party relating to the application or its use, including product liability claims, claims that the application fails to conform to legal or regulatory requirements, and claims arising under consumer protection or privacy legislation;
• Intellectual property: in the event of a third-party claim that the application infringes intellectual property rights, guito, and not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim;
• Legal compliance: the user represents that they are not located in a country subject to a United States Government embargo or designated by that Government as a "terrorist supporting" country, and that they are not listed on any United States Government list of prohibited or restricted parties;
• Third-party terms: when using the application, the user must comply with any applicable third-party terms (for example, the terms of their wireless carrier);
• Contact: questions, complaints or claims relating to the application should be directed to Luar Quieto — Unipessoal Lda through the contact details in section 1.

6.4. Free Trial

guito may offer a free 14-day trial of the Plus plan, which starts only when the user expressly accepts it in the application. The conditions depend on the route:

• On the guito.pt website, the trial requires no payment method and may be used once per account. At the end of the 14 days, if no paid plan has been subscribed, the account returns to the free plan without any charge;
• In the mobile apps, the trial is an introductory offer of the store attached to the subscription, subject to the store's eligibility rules. At the end of the 14 days, the store charges the price shown when the trial was accepted and the subscription then renews automatically, unless it is cancelled in the store's subscription settings at least 24 hours before the end of the trial;
• During the trial, access to Plus features is subject to the same conditions of use as the paid plan.

7. Right of Withdrawal (14 Days)

In accordance with Decreto-Lei n.º 24/2014 (transposing Diretiva 2011/83/UE), the user has the right to withdraw from this contract within 14 days of the initial subscription, without having to give any reason.

Scope: This right applies only to the first subscription. Automatic renewals form part of the initial contract that the user accepted and are not eligible for the right of withdrawal. To avoid future renewals, the user must cancel the subscription before the renewal date.

How to exercise this right: If you subscribed on guito.pt, contact us at support@guito.pt within the first 14 days. If you exercise this right, you will be refunded the amount paid for the initial subscription.

If you subscribed inside the mobile app, the payment was charged by the App Store or Google Play (section 6.3), so the request must be submitted to that store, through its own refund channels, and follows that store's terms. guito cannot process that refund, but can help identify the purchase concerned.

After the 14 days or renewals: If you decide to cancel the subscription after the 14-day period, or after an automatic renewal, there will be no refund for the period already paid, but access to the service will continue until the end of the current billing period.

8. Linking to Bank Accounts (Open Banking / PSD2)

guito allows you to link your bank accounts through services compliant with the Payment Services Directive (PSD2):

• GoCardless, an account information service provider (AISP) authorised under PSD2 and registered with the Banco de Portugal;
• The link is read-only — guito can never move funds;
• guito never directly accesses your banking credentials;
• You may revoke access at any time, by disconnecting the account directly in guito or in your bank's settings;
• Banking data is encrypted and stored securely.

9. Tax Calculators and Simulators

Our tax calculators (income tax, net salary, among others) are developed on the basis of the Portuguese tax legislation in force and are updated regularly to reflect the official tables and rules of the Autoridade Tributária e Aduaneira and the Segurança Social.

For most users with simple tax situations, the results are accurate. However, the user acknowledges that:

• Tax legislation may change after publication;
• Complex tax situations (multiple income sources, specific tax benefits, special regimes) may require personalised analysis;
• The results depend on the accuracy of the data entered by the user;
• guito accepts no responsibility for decisions taken on the basis of the results.

We recommend checking the results with the Autoridade Tributária e Aduaneira or a certified accountant before making important tax decisions.

10. Investment Tracking — Financial Disclaimer

guito provides tools for tracking investment portfolios and analysing financial assets.

guito does NOT provide financial, tax or investment advice. We are not an entity regulated by the Comissão do Mercado de Valores Mobiliários (CMVM) or any other financial authority.

The information, market data and tools provided are for informational purposes only and do not constitute:

• Recommendations to buy or sell assets;
• Personalised investment advice;
• Guarantees regarding future returns;
• Analysis suited to the user's individual risk profile.

Investments in financial assets carry risks, including the possible loss of the capital invested. For professional advice, consult a certified financial adviser or a regulated financial institution.

11. Data Storage

Data entered by users is stored securely on our system, in accordance with the General Data Protection Regulation (GDPR).

For unauthenticated users, some data may be temporarily stored on the device via Local Storage.

12. Ownership of User Data

The financial and personal data entered by the user remains their property. guito processes this data solely in order to provide the contracted services, as described in our Privacy Policy.

The user may delete their data at any time through the account settings (section 16.1) and obtain a complete copy of their data directly in the application, through the "Export your data" option in the account settings, or by request to support@guito.pt.

13. Intellectual Property

All content and materials made available on guito — including, but not limited to, texts, graphics, logos, icons, images, source code, algorithms and software — are the exclusive property of guito or its licensors, and are protected by copyright and other applicable intellectual property legislation.

It is prohibited to copy, modify, distribute, transmit, display, reproduce, publish or create derivative works without prior written authorisation.

14. Limitation of Liability

guito provides simulators, calculators and supporting financial information that are for informational purposes only. Despite our efforts to ensure the accuracy of the content, it may contain errors or omissions.

The user is entirely responsible for verifying the accuracy of the information before taking any financial, professional or personal decision based on the data presented.

guito is provided "as is" and "as available", without warranties of any kind, express or implied, including, but not limited to:

• Continuous and uninterrupted availability of the service;
• Absence of errors or technical failures;
• Suitability for any particular purpose;
• Absolute security against unauthorised access.

The user acknowledges that they use the service at their own risk.

guito is an informational tool. To the extent permitted by law, we accept no responsibility for:

• Financial or investment decisions taken on the basis of the information in the application;
• Temporary interruptions of the service or technical failures;
• Inaccuracies in data provided by third parties (market quotes, banking data);
• Financial losses resulting from the user's decisions.

15. Third-Party Integration

guito may integrate third-party services for specific features, including:

• Artificial intelligence features provided by a specialised third-party provider, including web search services used to identify merchants;
• Open Banking services compliant with PSD2;
• Market data and quote providers;
• Application analytics and improvement services.

These services are subject to their respective terms and privacy policies. guito does not control and is not responsible for the privacy practices or content of third parties.

15.1. External Artificial Intelligence Assistants Connected by the User

guito allows the user to connect an external artificial intelligence assistant of their choice (for example, Claude or ChatGPT) to their account, through a connection authorised by the user themselves. This feature is available on the Plus plan and during the free trial. When the user establishes this connection:

• It is the user who chooses the assistant and authorises access to their data; guito does not choose, contract or control that assistant;
• The assistant may read the user's financial data and, only with the user's express confirmation, change it;
• The data transmitted to the assistant is subject to the terms and privacy policy of that assistant's provider, and not to these Terms;
• The user may revoke the connection at any time in the account settings ("AI Assistants"), which ends the access immediately;
• guito is not responsible for the responses, actions or data-handling practices of the external assistant.

16. Account Suspension and Cancellation

16.1. Cancellation by the User

The user may cancel their account at any time through:

• The account settings in the application;
• An email to support@guito.pt with the subject "Account Cancellation".

Following a deletion request:

• Deletion is carried out after a 7-day grace period, during which the user may cancel the request by signing in;
• After that period, the account and the associated data are permanently deleted, except for records that the law requires us to keep, as set out in the Privacy Policy;
• A subscription purchased on guito.pt stops renewing from the request and ends with the deletion of the account, with no refund of the current period.

If the subscription was purchased through an app store (section 6.3), the effect of deleting the guito account depends on the store. An App Store subscription is not cancelled and must be cancelled by the user in the App Store subscription settings, otherwise the store will continue to charge the renewal. A Google Play subscription is cancelled by guito, with access retained until the end of the period already paid for; if that cancellation cannot be completed, the subscription must be cancelled in the Google Play subscription settings.

16.2. Suspension or Cancellation by guito

We reserve the right to suspend or cancel accounts, with prior notice wherever possible and without notice only in cases of fraud, abuse or legal requirement, in the following situations:

• Breach of these Terms and Conditions;
• Fraudulent or abusive use of the service;
• Non-payment of subscriptions (where applicable);
• Conduct that harms other users or the operation of the service;
• Legal requirement or court order.

17. Modifications to the Terms

We may update these Terms from time to time to reflect changes in our services, legal obligations or operational practices.

Changes are published on this page, with the revision date updated at the end. For material changes, we will notify registered users by email, with reasonable advance notice, before the changes take effect.

Continued use of guito after the changes take effect constitutes acceptance of the new Terms. If you do not agree with the changes, you must cease using the service before they take effect.

18. Governing Law and Dispute Resolution

These Terms are governed by Portuguese law. Mandatory consumer protection rules are safeguarded, including the consumer's right to bring proceedings before the courts of their place of domicile. Without prejudice to those rules, the courts of the district of Lisbon, Portugal, shall have jurisdiction.

18.1. Alternative Dispute Resolution

In accordance with consumer protection legislation, the user may resort to alternative dispute resolution bodies:

19. General Provisions

19.1. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between the user and guito regarding the use of the services.

19.2. Severability Clause

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19.3. Waiver

The failure of guito to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

19.4. Assignment

guito may assign or transfer these Terms in the context of a restructuring, merger or acquisition, informing the user with reasonable advance notice and provided that the assignee assumes full compliance with these Terms and the Privacy Policy. The user may not assign or transfer their rights or obligations under these Terms without the prior written consent of guito.
